Overview

This website, trailsentinel.com, is operated by 304 Holdings LLC, a limited liability company registered in New Mexico, United States, trading as TrailSentinel ("TrailSentinel", "we", "us", "our"). We sell trail cameras, kits and accessories to customers in Australia.

By visiting our site or buying something from us, you use our "Service" and agree to these Terms of Service, together with the policies they refer to: our Terms of Sale, Shipping Policy, Refund & Returns Policy and Privacy Policy. Please read them before you order. If you do not agree with them, please do not use the site.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded by agreement. Where these terms and the law conflict, the law wins.

Our store is hosted on Shopify Inc., which provides the online platform that allows us to sell our products to you.

Delivery

Every order ships free, tracked, Australia-wide. We dispatch within 1 to 3 business days (that includes setting up and testing your camera before it leaves) and delivery usually takes a further 7 to 12 business days. Rural and remote addresses can take a few days longer. Orders ship from our fulfilment partner's warehouse outside Australia, and dispatch pauses during Chinese New Year and the first week of October. You receive a tracking link by email as soon as the parcel is on its way. If you have not received a tracking link within 4 business days of ordering, email support@trailsentinel.com and we will send it to you. Full details are in our Shipping Policy.

1. Using our online store

By using this site you confirm that you are at least 18 years old, or that you are using it with the consent of a parent or guardian.

You may not use our products or our site for any unlawful purpose, and you must not, in using the Service, breach any law that applies to you, including surveillance and privacy laws. See "Using cameras lawfully" below.

You must not transmit viruses, malicious code or anything designed to interfere with the site. A breach of these terms may result in us refusing you access to the site.

2. General conditions

We may refuse service to anyone, for any lawful reason, at any time.

Content you send us (other than payment card details) may be transferred unencrypted across networks and adapted to the technical requirements of connecting networks or devices. Payment card information is always encrypted in transit.

You agree not to reproduce, duplicate, copy, sell or exploit any part of the Service without our written permission.

3. Accuracy of information

We work hard to keep product information accurate. Battery life, detection range and data use are given as realistic ranges, and every product page says what is in the box. Product photos show the product as accurately as we can, but screens vary and we cannot guarantee that colours will display exactly. If something on the site is wrong, tell us and we will fix it.

4. Changes to the Service and prices

Prices are shown in Australian dollars and may change without notice. The price that applies to your order is the price shown at the time you place it. We may change or discontinue any product or part of the Service at any time; this does not affect orders we have already confirmed.

5. Products

Some products may be available in limited quantities. Returns and exchanges are governed by our Refund & Returns Policy.

We sell to consumers in Australia. We may limit or decline orders that appear to be for resale, or that request unusually large quantities, and we will tell you if we do.

Our 4G cameras need a SIM card and mobile coverage at the place they are installed. We do not sell SIM cards or data plans and we do not charge a subscription. Mobile network coverage is provided by the carriers, not by us; if your 4G camera cannot get a usable signal where you need it, our Signal Guarantee applies.

6. Orders, billing and account information

We may cancel an order if we suspect fraud, if a product is unavailable, if there was an obvious pricing error, or if the delivery address is outside Australia. If we cancel an order you have paid for, we tell you why and refund you in full within 5 business days.

You agree to give us accurate, complete and current order details, including a delivery address that a carrier can reach and a phone number for the driver, and to update them if they change. The way we form a contract with you, and your rights when you buy, are set out in the Terms of Sale.

7. Optional tools and third-party links

We may give you access to third-party tools (for example the camera manufacturer's phone app, a carrier's coverage map, a payment provider or a shipping tracker). We do not control these tools. They are provided "as is", subject to their own terms, and we are not responsible for them, except where the law says otherwise.

Links on our site may take you to third-party websites that are not affiliated with us. We are not responsible for their content, products or privacy practices. Any complaint about a third-party product should go to that third party.

8. Reviews, comments and other content you send us

If you send us a review, a photo, a suggestion or other content, you give us a non-exclusive, royalty-free, worldwide licence to use, edit and publish it in connection with our business, and you confirm that you have the right to do so and that it is not unlawful, defamatory or infringing. We only publish reviews from real customers and we never pay for or fabricate them. We may remove content that we consider unlawful, offensive or misleading. We are not obliged to keep it confidential, to pay for it or to respond to it.

10. Errors, inaccuracies and omissions

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery times or availability. We may correct any errors and update or cancel orders affected by them, at any time, including after you have placed an order. If we cancel your order for this reason, we refund you in full within 5 business days.

11. Prohibited uses

You must not use the site or its content: (a) for any unlawful purpose; (b) to ask others to do anything unlawful; (c) to breach any Australian or international law; (d) to infringe our intellectual property or anyone else's; (e) to harass, abuse, defame or discriminate against anyone; (f) to submit false or misleading information; (g) to upload viruses or malicious code; (h) to collect or track other people's personal information; (i) to spam, phish, scrape or crawl the site; or (j) to interfere with the security of the site. We may terminate your use of the site for breaching these rules.

12. Using cameras lawfully

You are responsible for using your camera in line with the law where it is installed. Every Australian state and territory has surveillance and privacy laws that restrict recording people's private activities and conversations without consent. Keep cameras pointed at your own property, do not record private spaces such as neighbours' homes, workers' quarters or bathrooms, consider switching off audio recording, and get the land manager's permission before leaving a camera on land you do not own. 13. Guarantees and limitation of liability

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Subject to those guarantees and to any other rights you have under law, and to the maximum extent the law allows: (a) the website itself is provided "as is" and we do not promise it will be uninterrupted or error-free; (b) we are not liable for indirect or consequential loss (such as lost profits or lost data) arising from your use of the site; and (c) a trail camera records what happens in front of it. It does not prevent theft, damage or trespass, and we are not liable for loss that a camera did not prevent, for interruptions to mobile networks, or for the acts of third parties.

Where the law allows us to limit our liability for a breach of a consumer guarantee, our liability is limited, at our option, to replacing the goods, supplying equivalent goods, repairing them, or paying the cost of doing so.

14. Indemnity

You agree to compensate us for any loss we reasonably suffer because of your breach of these terms or your unlawful use of the site or our products. This does not apply to loss caused by our own fault.

15. Severability

If any part of these terms is found to be unlawful or unenforceable, that part is removed or read down to the extent needed, and the rest of the terms continue to apply.

16. Termination

These terms apply until ended by you or by us. You can end them at any time by no longer using the site. We may end them, and refuse you access to the site, if we reasonably believe you have breached them. Obligations that arose before termination survive it.

17. Entire agreement

These terms and the policies they refer to are the whole agreement between you and us about your use of the site, and replace any earlier communications on the subject. If we do not enforce a part of these terms, that is not a waiver of it.

18. Governing law

These terms are governed by the laws of New South Wales, Australia, and the courts of that jurisdiction have non-exclusive jurisdiction. Nothing in this clause limits your rights under the Australian Consumer Law or your right to bring a claim in the state or territory where you live.

19. Changes to these terms

The current version is always on this page. We may update these terms by posting the changes here; the "Last updated" date tells you when. The version that applies to an order is the one in force when the order was placed.
