1. Who these terms apply to

These Terms of Sale apply to every purchase made on kelpiecam.com from 304 Holdings LLC, trading as KelpieCam ("we", "us", "our"), by a customer in Australia ("you"). They cover ordering, payment, delivery, returns and guarantees. They work together with our Terms of Service, Shipping Policy, Refund & Returns Policy and Privacy Policy.

These terms may change from time to time. The version that applies to your order is the one published on the site on the day you place it. Nothing in these terms excludes or limits your rights under the Australian Consumer Law.

2. What we sell

We sell 4G cellular trail cameras and trail camera accessories. The current range, with prices, is shown on the site.

The main characteristics of each product, including what is in the box, are on its product page. Please read the product page before ordering: choosing the right camera for your spot is your decision, and we are happy to help by email if you tell us what you want to watch and roughly where. We only publish technical figures we can stand behind, and we state them as realistic ranges. Photos are as accurate as we can make them but are not contractual.

Products are offered while stocks last. If a product you have ordered turns out to be unavailable, we tell you within 2 business days and offer you a comparable product or a full refund.

3. Our details

KelpieCam is operated by 304 Holdings LLC, a limited liability company registered in New Mexico, United States. Registered office: 1380 Avenida Rincon, Apt 304, Santa Fe, NM 87506, United States. 4. Placing an order

You order by adding products to your cart and completing checkout. Before you pay, you can review your order, the total price and your details, and correct any mistakes. Placing an order confirms that you accept these Terms of Sale and our Terms of Service.

Your order is an offer to buy. We accept it, and a contract is formed, when we send you the order confirmation email. Until then we may decline an order, for example if we suspect fraud, if a product is unavailable, if there was an obvious pricing error, or if the delivery address is outside Australia. If we decline an order you have already paid, we refund you in full within 5 business days.

Records held in our systems are evidence of the orders placed with us, unless proved otherwise. We may decline orders from customers who have an unresolved payment dispute with us, and orders that appear to be for resale or that request unusually large quantities.

5. Changing or cancelling an order

You can change or cancel an order free of charge at any time before it is dispatched: email support@kelpiecam.com with your order number. Because we dispatch within 1 to 3 business days, please do this as soon as possible. If we cannot make the change you ask for, we will tell you and you can keep the original order or cancel it for a full refund. Once an order has been dispatched, our 30-day returns apply instead (see section 10).

6. Prices

Prices are in Australian dollars (AUD) and include GST where applicable. Delivery is included: the price shown at checkout is the price you pay, with no shipping charge and no import duties or charges when the parcel arrives.

The price that applies is the price shown on the site when you place your order, including any promotion in force at that time. Prices may change at any time for future orders. If a price on the site is obviously wrong, we will contact you before dispatch and you can confirm the order at the correct price or cancel it for a full refund.

7. Payment

The full price is payable when you place the order. The payment methods available for your order are shown at checkout. Payments are processed on secure, PCI-DSS compliant systems. We never see or store your full card number.

A card payment is final once the order is confirmed, except in the case of fraudulent use of the card, in which case you can ask for the payment to be cancelled and refunded.

8. Delivery

We deliver to all Australian states and territories, including rural properties and roadside mail services. We do not currently deliver outside Australia.

Orders are packed and shipped by our fulfilment partner from its warehouse outside Australia, and dispatched within 1 to 3 business days of your order confirmation. Delivery then usually takes 7 to 12 business days, so 8 to 15 business days from order to door; rural and remote addresses can take a few days longer. Business days are Monday to Friday, excluding public holidays. Dispatch pauses during Chinese New Year and the first week of October: if your order is affected, we email you the new dispatch date, and you can cancel for a full refund if it no longer suits you. These times are our honest estimate, not a guarantee, and carriers occasionally run late.

You receive an order confirmation email when you order and a dispatch email with a tracking link when the parcel leaves. A large order may ship as more than one parcel, each with its own tracking link. The carrier depends on the weight and size of your order and your address.

If your order has not been delivered within 20 business days of dispatch, for any reason other than an event outside our control or something on your side (such as an incorrect address or an uncollected parcel), you can cancel the order and we refund you in full within 5 business days, or we send a replacement, whichever you prefer. If a parcel is lost or arrives damaged, we replace it or refund you; you do not have to deal with the carrier. See our Shipping Policy.

9. Title and risk

Ownership of the products passes to you when we receive full payment. Risk of loss or damage passes to you when the products are delivered to the address you gave us. Until then, the parcel travels at our risk.

10. Returns and the Signal Guarantee

You can return any product within 30 days of delivery, for any reason, with no restocking fee. Send it back complete and in a condition we can resell; marks from mounting it and trying it on your place are fine. For a change of mind you pay the return postage. We refund the full purchase price to your original payment method within 5 business days of the parcel arriving.

If a 4G camera cannot get a usable signal at the spot you bought it for, and we cannot fix it together, our Signal Guarantee gives you a full refund, including any shipping you paid, and we pay the return postage. You have 30 days from delivery.

11. Consumer guarantees and our 24-month warranty

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

In addition, every KelpieCam camera and accessory is covered by our 24-month warranty against defects in materials and workmanship, from the date of delivery. To claim, email support@kelpiecam.com with your order number and a description of the fault (photos or a short video help). We reply within 1 business day. Where the item needs to come back to us, we cover the reasonable cost of returning it and of sending the repaired or replacement item to you. The warranty is given by 304 Holdings LLC, trading as KelpieCam, 1380 Avenida Rincon, Apt 304, Santa Fe, NM 87506, United States, email support@kelpiecam.com, and its benefits are in addition to your rights under the Australian Consumer Law.

The warranty does not cover theft; damage caused by animals, vehicles, firearms, lightning or fire; water damage from a housing left open; damage from batteries we do not recommend; or modifications. These exclusions do not limit your rights under the Australian Consumer Law.

Some accessories also carry their manufacturer's own warranty, such as the SanDisk limited warranty on SanDisk memory cards. You can claim under our warranty or the manufacturer's, whichever suits you.

If a product is faulty, damaged in transit or not what you ordered, we repair it, replace it or refund it, and we pay all return postage. For a major failure you choose between a replacement and a refund.

12. SIM cards, data and mobile networks

4G cameras need a SIM card with data, bought from a mobile carrier of your choice, and mobile coverage at the exact spot where the camera is installed. We do not sell SIM cards or data, we do not charge a subscription, and we are not responsible for carrier coverage, outages, pricing or terms. Photos sent by a 4G camera pass through the camera app provider's service to your phone; that service has its own terms. Optional paid features inside that app, such as cloud storage plans, are sold by the app provider, not by us.

13. Setup help

Every camera comes with free setup help. Email us with your order number and, if you need it, we book a call and stay on the line until a photo arrives on your phone. Setup help does not change your returns, Signal Guarantee or warranty rights.

14. Using cameras lawfully

You are responsible for installing and using your camera in accordance with the surveillance, privacy and land-access laws that apply where it is installed. Our page Cameras and the law gives general information only.

15. Liability

To the extent the law allows, and without limiting the consumer guarantees above, we are not liable for indirect or consequential loss, for loss that a camera did not prevent (a camera records events; it does not stop theft, damage or trespass), for interruptions to mobile networks, or for loss caused by using a product other than as instructed. Where the law allows us to limit our liability for breach of a consumer guarantee, it is limited, at our option, to replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so.

16. Events outside our control

Neither of us is liable for a delay or failure caused by an event outside our reasonable control, such as a natural disaster, a carrier or network outage, industrial action or a government restriction. If such an event delays your order by more than 20 business days, you can cancel it for a full refund.

17. Intellectual property

The content of this site (text, photos, graphics, logos, guides) belongs to us or our licensors and is protected by copyright and trade mark law. You may not reproduce it without our written permission. Third-party brand names mentioned on the site belong to their owners and do not imply any affiliation.

18. Personal information

We collect the personal information needed to process and deliver your order and to provide support, and we share it only as described in our Privacy Policy, which also explains how to access, correct or complain about our handling of it.

19. Governing law and disputes

These terms are governed by the laws of New South Wales, Australia. If you have a problem with an order, please email us first: most issues are sorted within a day. If we cannot resolve it, you can contact the consumer protection agency in your state or territory (for example NSW Fair Trading or Consumer Affairs Victoria) or the ACCC, or take the matter to the court or tribunal with jurisdiction where you live. Nothing in this clause limits your rights under the Australian Consumer Law.
